Dr. Cassiel Ato Forson, a former Deputy Minister of Finance, has withdrawn his application for recusal against Justice Afia Serwah Asare-Botwe, a Justice of the Court of Appeal sitting as an additional High Court judge.
The application, filed on June 29, 2023, sought the trial judge's recusal based on alleged bias against the accused. Dr. Forson's lawyer, Dr. Abdul Aziz Bamba, cited pre-juridical comments made by the judge during the trial process.
Justice Asare-Botwe subsequently struck out the application as withdrawn. Mr. Godwin Edudzi Tameklo, standing in for Dr. Bamba, requested the release of Dr. Forson's passport until October 1, 2023. The judge granted the request, ordering Dr. Forson to return the passport to the Court's Registrar by 12 noon on October 2, 2023.
Dr. Forson, Dr. Sylvester Anemana (Former Chief Director of the Ministry of Health), and Mr. Richard Dzakpa (Businessman) are being prosecuted over the purchase of ambulances.
Dr. Forson faces charges of causing financial loss and intentionally misapplying public property. Dr. Anemana and Mr. Dzakpa were granted bail as well.
Earlier, a petition to transfer the case to a different judge was dismissed by Chief Justice Gertrude Araba Sackey Torkornoo. The trial is adjourned to October 2, 2023, in the new legal year.
