The (GACL) has been directed by the Right to Information Commission to release its contract with Frontiers Health Services to Joy News.

The Commission's decision comes after a review of a request filed by Joy News, which had sought the release of the contract as well as information on the revenue generated from testing at the airport.

In a September 19, 2022 letter, GACL's Managing Director, Mrs Pamela Djamson-Tettey, stated her inability to release the information as the agreement contained information exempt under Section 10 of the Right to Information (RTI) law.

According to Section 10 of the RTI law, information can be exempt from disclosure prior to official publication if it contains trade secrets or financial, commercial, scientific, or technical information that belongs to the state or public institution and has monetary or potential monetary value.

Additionally, the disclosure of the information could reasonably be expected to affect the integrity or stability of the financial system, damage the financial interests of the state or public institution, cause a disruption of business or trade in the country, or unduly benefit or be injurious to a person.

However, the Commission's decision, communicated in a February 3, 2023 letter, stated that the information does not fall within the category of exempt information envisaged under sections 10(a) and (b) of the RTI law.

The contract, which has already been executed, has neither monetary nor potential monetary value to the state and the release of the information will not damage the financial interests of the state, according to the letter written by Executive Yaw Sarpong.

GACL has been ordered to comply with the Commission's decision within seven days upon receipt of the letter and to provide the following in addition to the contract: a summary of the procurement information on the GACL and Frontiers Healthcare Services Ltd. transaction, excluding tax information and evaluative processes; the total amount of money generated from Covid-19 testing at the airport from the inception of the agreement with Frontiers; the total amount of money made by Frontiers Health Services from the Covid-19 testing at the airport; and the total amount of money made by the government from the Covid-19 testing at the airport from the inception of the contract with Frontiers till date.
