The National Democratic Congress (NDC) has expressed its readiness for a bye-election following the Supreme Court's ruling to expunge the records of Mr James Gyakye Quayson, Member of Parliament (MP) for Assin North.
In a statement issued by Mr Fifi Kwetey, the General Secretary of the NDC, the party stated that it is fully prepared for the bye-election resulting from the court's decision, after consultations with Mr Gyakye Quayson.
The NDC assured its complete support for Mr Gyakye Quayson, including the backing of the Minority Caucus in Parliament, with the aim of ensuring an even more decisive victory for him in the upcoming bye-election.
The party acknowledged the Supreme Court's decision to invalidate Mr James Gyakye-Quayson's nomination, election, and swearing-in as unconstitutional, stating that the court did not provide reasons but indicated that they would be available on or before June 7th.
The statement expressed surprise at the Supreme Court's decision, considering previous rulings that asserted the court's lack of jurisdiction over parliamentary elections and suggested that such matters should be taken to the High Court.
The NDC emphasized that Mr James Gyakye-Quayson did not owe allegiance to any other country at the time of his nomination, election, and swearing-in, and anticipated the court's reasoning for its decision.
Background
The Supreme Court ruled that the Electoral Commission (EC) acted unconstitutionally by allowing Mr Quayson to contest the 2020 parliamentary elections without providing proof of renouncing his Canadian citizenship.
The case was filed by Michael Ankomah Nimfah, a resident of the Assin North Constituency, who argued that Mr Quayson was not qualified to contest as a Member of Parliament based on the interpretation of Article 94(2)(a) of the Ghanaian Constitution, which prohibits individuals with dual nationality from holding certain public offices, including that of an MP.
